As I was reading through all of the fallout discussions from Roberts’ decision on Obamacare, it suddenly occurred to me that most of the analysis to date has been done under the assumption that the Commerce Clause was the keystone of the legislation, not the power of Congress to tax. What happens when you look at Obamacare from a perspective of Congress’ ability to tax?

In March of 1937, in West Coast Hotel Co. v. Parrish erstwhile conservative Justice Owen Roberts suddenly began voting to support New Deal legislation. His change of heart was the beginning of what became known as “The switch in time that saved nine.” His sudden reversal was in direct response to FDR’s threat to pack the Court in the face of the Court’s resistance to the President’s sweeping progressive agenda. From that point forward the Constitution ceased to be a significant barrier to anything FDR wanted to do.

Chief Justice Roberts opinion is that the mandate violates the Commerce Clause but since he believes it is a tax, and that it was within Congresses power to tax, the violation of the Commerce Clause doesn’t matter.

I came across an absurd USA Today story from last week that I just couldn’t let pass without reacting to. From the very first lines I struggled to keep my jaw from dislodging from my face and falling to the dirt.

An 18-year-old Amish man died from oxygen deprivation and his 14-year-old brother was injured last month as they worked in a neighbor’s farm silo in Pennsylvania. Also last month, a Maryland man and his sons, 18 and 14, died of asphyxiation while working in a farm manure pit.
