OWS Leftist Lawyers threaten to clog NY courts

The OWS leftist attorneys from the National Lawyers Guild have issued a threat to the Manhattan courts… drop all the charges against the OWS protestors, or we will clog the courts.

Lawyers representing about 800 Occupy Wall Street protesters arrested in the past month demand that prosecutors drop the charges.

If not, they say they won’t deal and will insist on going to trial – putting pressure on the already overloaded Manhattan criminal courts.

“I’d like to suggest to the DA’s office the appropriate way to deal with these cases is outright dismissal,” said defense lawyer Martin Stolar.

“The leverage is, we take them all to trial.”

Manhattan’s response? Have at it…

The Manhattan criminal courts deal with about 90,000 cases a year, and prosecutors say they will have little trouble absorbing the extra work load.

Court officials had a different take.

“Is it a strain on the system? Yes,” said courts spokesman David Bookstaver. “But the reality is the judges will deal with it.”

Hey… I’ve got no problem with that. Unless you’re a terrorist, actively waging war against the US, every one has a right to their day in court. But many of the protestors don’t seem to consider resisting arrest as against the law. Case in point… the DA dismissed charges against 1166 people protesting the police shooting of immigrant street vendor, Amadou Diallo, back in 1999.

But are the circumstances the same with the OWS arrestees? Not according to the former DA, Raymond Castello.

The Diallo protesters, he said, were arrested peaceably.

“Their plan was to get arrested, and they did it in a way that was least inconvenient for all parties,” Castello said.

“Resisting arrest makes a difference,” he said.

It certainly does.

But the NLG, an overt progressive guild of leftist lawyers, never lets a little thing like laws stand in the way of a legal agenda. Perhaps it’s membership can best be exemplified by Lynne Stewart – the NLG lawyer who not only lost representing Omar “The Blind Sheikh” Abdel-Rahman, but managed to get herself arrested and convicted for helping Abdel-Rahman pass messages to his terrorist followers.

Then again, encouraging lots of court cases, and potential appeals, enriches those evil capitalists, the National Lawyers Guild, doesn’t it? Hardly seems to fit the anti-capitalist narrative that they apparently parrot at every corner.

The man behind the threats – OWS attorney, Martin Stolar – has a similar failure record with his unsuccessful representation of Shahawar Matin Siraj, a Pakistani immigrant arrested in NYC days before the 2004 Republican Convention for a plot to bomb the Herald Square subway station. At least, unlike Stewart, he managed to avoid any incarceration himself, while arguing police entrapment for his client.

Stolar didn’t do much better for ELF enviro terrorist, Daniel McGown, who – as part of a 2007 plea agreement (ala better than if he went to trial) – was sentenced to seven years and ordered to pay $1.9 million in restitution for burning two Oregon logging related businesses in 2001.

Then, of course, it comes as no surprise that the guy who just happened to find himself under a motorcycle, Harry Douglas, coincidentally also happened to be functioning as NLG’s “legal observer” at the time.

Is it because his mother never taught him to look both ways when crossing the street? Or, considering the less than credible history of NLG’s legal staffers, was he just trying to drum up a bit more business and press by faking being hit, as both independent observers and media press accounts (AP and New York Daily News photographer) insist via first hand testimony?

Oh yes… in case any of you have been missing the entertainment of Keith Overbite in your lives, here’s his dramatic news blurb on the incident, where he notes that despite witnesses who saw the NLG “observer” – (“observers”=typically law students, legal workers or attorneys not licensed locally) – deliberately put his foot under the motorcycle to appear “trapped”, good ol’ sports boy, Keith, is still confused where the blood came from.

Hummm… lots of ways to get face road rash, you know. Perhaps writhing on the pavement, face down, thrashing your head back and forth, while resisting arrest? sigh…

But of course the story is ol Harry, who hasn’t learned how to cross a street when there’s traffic, “wasn’t part of” the OWS protest. Oh no. Of course Harry, and the law firm for whom he works, are completely “disassociated” with the movement. You’ve got to be really gullible to buy into this when it’s on record from genuine detached observers that he *deliberately* attempted to looked trapped and victimized.

I guess that Douglas may have taken into account the failure rate of his NLG’s attorney members since he outsourced his defense to Yetta Kurland, Liberty Park Working Group, who is founder of Kurland & Associates, her Park Ave law firm. Ms. Kurland also happens to be running for a city Council seat in Peter King’s NY’s 3rd District. There’s a bit of free campaign press for her…

Needless to say, it’s not hard to figure out the political leanings of the NLG by their choice of both attorneys and clientele. And while so many gullible believers dearly want to believe the OWS is not about “left vs right”, glaring facts tend to get in the way.

As time goes on, those vested in seeing OWS not only a success, but achieving abused victim status, are going to be rising to the surface on the media. It behooves a patient conservative constituency to allow the OWS to not only play out their scenes of chaos, but to manage to hang themselves for any sane support in the process.

Run the mill. 1k fine and 1 yr of weekends. Too simple. Finding and holding a job will be the ultimate challenge.

These uneducated and ignorant people believe they are entitled to everything free and now believe no law applies to them? What they don’t realize is that if they get what they want they will be treated the same as in other communistic countries, they will be incarcerated or just shot down where they stand. One good thing has come of this, Barry has shown his true colors by supporting these protestors and he is all red. Barry and his band of stinking useful idiots are disgusting.

They wanted to go to jail to make their point, let them stay there until a trial – that should make ours!

These liberals know their business when it comes to using the courts to achieve their agendas. They have resorted to sympathetic judges to get old laws off the books, and new laws that favor their beliefs on the books in about every state dealing with marriage, parent rights, juvenile rights, and of course Gitmo where they clogged the system down for years, and then had the laws made more terrorist friendly with the help of Obi. They have a mission like conservatives do, and are becoming more organized than they were. Couple that with Rhinos who are constantly monitoring the poll numbers and the feelings of the average American will sit idly by for fear of losing their precious seat. While they all had to take an oath to protect the nation against enemies foreign and domestic.
In short unless the main man, no not Obi but God sends in a snow storm this mess will continue to benefit these communist/socialist. Every day this drags on their backers increase in numbers. Their imagine as “poor pitiful and mistreated citizens” continues to gain more ground around the world, and now Obi is using these beatened down victims of capitalism to his advantage. The revolution is really entering a new and more active stage, and many of our conservative politicians are hiding under their desks to see who wins this one. And in my book, a Rhino is worse than the liberals. At least a liberal has the courage to tell us who they are.( Most of the time)

Rush broached something this afternoon and it needs a plow much deeper than what I can dig; but, nevertheless here it goes, there exists a deep seeded relationship including John Zuccotti former Chairman of the Board of Brookfield Properties (NYSE: BPO) a long-term moneycrat going back to Mayor John Lindsey days, Diane Taylor the control junkie girlfriend of Mayor Bloomberg and board member of Brookfield (owners of the property where the OM (Occupation Movement) squats and some leased or owned real estate in New Hampshire destined to be a wind farm. Supposedly GE agrees to provide the wind turbines predicated on a $145 million dollar loan guarantee which brings in the Obama gang to complete the manage’ a trois so the subterfuge is an exchange of a political favor for a financial favor of a government (that means you) backed loan.

Disbar the whole lot.

This is what happens when you’ve arrested hundreds of people who were inconveniently exercising their First Amendment rights, and then realize that the only law most have actually broken was resisting arrest.

Most of those 1,000 arrests have resulted in desk appearance tickets for such violations as obstruction of government administration and disorderly conduct.
Guild members had appeared at about 90 arraignments as of Monday, and most defendants have been released on their own recognizance, according to Stolar.

On Monday, Stolar asked prosecutors from the Manhattan district attorney’s office to dismiss all disorderly conduct charges stemming from the mass arrests on the Brooklyn Bridge and a separate march to Union Square. That would drop charges against some 760 people, said Stolar. Prosecutors are considering the proposal, he says.

DA’s version:

Erin Duggan, a spokesman for Manhattan district attorney Cyrus Vance, Jr., says, “Every arrest that comes into the D.A.’s office is assessed individually, and charging decisions are based on the evidence and circumstances unique to each case and defendant.” By her office’s count, police have arrested about 500 Occupy Wall Street protesters, including 267 on the Brooklyn Bridge. That tally does not include protesters who were issued summonses. The New York City Police Department did not respond to a request for its arrest total.

Discrepancy….much?

Nobody has been arrested for excercising First Amendment free speech rights. Arrests have been for tresspassing, blocking traffic, camping without permission and such – things that anybody would be arrested for. There are plenty of other offenses that have been overlooked – taking a dump in a park or smoking dope in public will get you ticketed or arrested most places I know, but not at Occupy Wall Street. They have been given a pass.

so if their lawyers want to push it, the judge can push it to re-establish other felony they have disregard .
and on another note that mean the offenders will carry a dossier like felons?
