Call it an act of legislative legerdemain. Barack Obama, who is really good at taunting, taunted anyone who dared oppose the king:
President Obama insisted Tuesday that his successor won’t take the political risk that would come with reversing his recent executive action on immigration reform.
Speaking at a town-hall meeting in Nashville, the president said it’s “theoretically” possible that the next administration could undo the amnesty Mr. Obama has granted to more than 4 million illegal immigrants, but he assured a crowd of undocumented Americans that such a step it is extremely unlikely.
“It’s true a future administration might try to reverse some of our policies. But I’ll be honest with you — the American people basically have a good heart and want to treat people fairly and every survey shows that if, in fact, somebody has come out and subjected themselves to a background check, registered, paid their taxes, the American people support allowing them to stay. So any future administration that tried to punish people for doing the right thing, I think, would not have the support of the American people,” Mr. Obama said. “It’s true, theoretically, a future administration could do something that I think would be very damaging. It’s not likely, politically, that they reverse everything we’ve done.”
Last month, the president unveiled long-awaited executive action on immigration reform. He granted de facto amnesty to more than 4 million illegal immigrants, freeing them from the threat of deportation and allowing them to legally compete for jobs.
But reversing his action will be a piece of cake, since he didn’t sign a thing:
WASHINGTON – Sen. Jeff Sessions, R-Ala., a leading opponent of President Obama’s move to provide amnesty for up to 5 million illegal immigrants, expressed astonishment Monday and ridiculed the administration for not carrying out the action through an executive order.
In remarks made at the Washington office of the government-watchdog group Judicial Watch, Sessions said: “I guess they just whispered in the ear of (DHS Director) Jeh Johnson over at Homeland Security, ‘Just put out a memo. That way we don’t have to enforce the law.’”
The news that Obama had not signed an executive order to carry out the policy he announced to the nation in a televised address Nov. 20 was broken by WND Senior Staff Writer Jerome Corsi last week.
As a result of the president’s use of a memo instead of an official order, the senator observed: “We don’t even have a really significant, direct, legal direction that we can ascertain, precisely what the president is doing. It’s a stunning event in my view.”
Why didn’t he sign something? Because it would be extra-Constitutional:
“Barack Obama did not issue an executive order, because he does not have the authority to issue an executive order in this instance,” Fitton said.
He believes White House counsel concluded Obama lacked the authority to defer prosecutions under the Deferred Action for Childhood Arrivals, DACA, program and decided to implement the policy through a memorandum issued by Department of Homeland Security Secretary Jeh Johnson. The memo was never filed with the Federal Register for a period of public comment, as federal law requires agencies to do when making rules.
“Jeh Johnson did the bidding of his boss, engaging in a political act, not a legal act, that involves misappropriating public funds to open offices and hire employees to implement the directives of Johnson’s memorandum,” Fitton said.
Obama is blowing smoke. There’s nothing to reverse. Obama has chosen not to enforce the law. All anyone has to do is enforce the law. Period.
