REP. BOB GOODLATTE (R-VA): Professor Turley, the constitution, the system of separated powers is not simply about stopping one branch of government from usurping another. It’s about protecting the liberty of Americans from the dangers of concentrated government power. How does the president’s unilateral modification of act of Congress affect both the balance of power between the political branches and the liberty interests of the American people?

JONATHAN TURLEY: Thank you, Mr. Chairman. The danger is quite severe. The problem with what the president is doing is that he’s not simply posing a danger to the constitutional system. He’s becoming the very danger the Constitution was designed to avoid. That is the concentration of power in every single branch.

This Newtonian orbit that the three branches exist in is a delicate one but it is designed to prevent this type of concentration. There is two trends going on which should be of equal concern to all members of Congress. One is that we have had the radical expansion of presidential powers under both President Bush and President Obama. We have what many once called an imperial presidency model of largely unchecked authority. And with that trend we also have the continued rise of this fourth branch. We have agencies that are quite large that issue regulations. The Supreme Court said recently that agencies could actually define their own or interpret their own jurisdiction.

And again we are reminded… In a Constitutional Republic or even a Democracy, the will of the people guide and direct the politicians; in a dictatorship, the will of the ruler over-rule the will of the people. So what kind of government do we have? Here’s a couple more hints…the “leader” of our country has two methods in which he must choose, one, to govern the country through legislation, as directed by the Constitution; or two, he chooses to rule via regulation.

Obama has a basic prolem he hasn’t and will not overcome. He doesn’t know what type of government we are supposed to have. The Constitution tells us we have a (fragile) Representative Republic; today I heard yet another Obama speech on the radio during which he referred to his actions as “protecting our democracy”. He must not understand that we aren’t supposed to have a democracy, funny coming out of the mouth of someone who claims to be a Constitutional Scholar. No wonder he has no fear of violating the Constitution, he doesn’t have a clue what it says, or what it means.

Concentration of power under the office President is the opposite of a democracy. It is a transformation into despotism.

Mark my words The way the President disregards our Constitution, I believe his people are looking for ways to
over ride the two term limit. He will start talking about needing more time to complete his agenda. He will stress the improving economy , increased job numbers ……….The same BS he talks about now. (One drawback is IF Obamacare fails).
Don’t discount this as I recall the mayor of a large North East City did some years ago.

Just go read the Declaration of Independence.
Same old stuff. Rules made in London by persons who were not accountable controlled our destiny.
Despots have this in common: they do not care about their subjects. Our modern despot cannot be distinguished from George III.
For example, the current iteration of the ACA bears no resemblance to that “enacted” by Congress. This has been amply documented elsewhere.
But the Despot makes free to impose new laws, suspend existing laws, and do whatever he pleases, since he is not accountable to anyone.
Time for another revolution.
