Jack Smith’s Reality Check: Why Chutkan’s Speedy Trial Plan Just Backfired

This means the earliest any status hearing could occur is mid September.

He’s not just worried about SCOTUS’ Fischer and immunity opinions but Cannon’s thoughtful 93-page opinion concluding his appointment is unconstitutional

 
This is pretty embarrassing for Tanya Chutkan. She tried to give DOJ a rocket docket post-SCOTUS and Jack Smith had to say, whoa ma’am we ain’t ready.

Aside from what I’ve already noted—the need for Smith to consider both Fischer and immunity decisions against his existing J6 indictment—it’s important to understand that Smith’s entire indictment is tainted beyond repair because SCOTUS also determined immune conduct cannot be introduced as evidence in any proceeding including grand jury.

Smith subpoenaed numerous WH officials including Mike Pence and DOJ lawyers—SCOTUS definitely concluded Trump’s conversations with DOJ about election fraud falls well within the scope of a president’s “official acts.”

SCOTUS further concluded Trump’s meetings and conversations with his vice president were “presumably” immune.

Aside from witnesses, who knows the amount of protected records Smith seized from various officials and advisors that cannot be entered into evidence?

The fact Chutkan—who was roundly condemned by John Roberts for failing to exercise caution and due diligence before issuing her historic order denying presidential immunity—learned nothing from SCOTUS rebuke and is again rushing a political case and even has to be slowed by Jack Smith demonstrates her unfitness for the federal bench.
