A top federal court on Wednesday ruled that people held for months on end for immigration violations following Sept. 11, 2001, can sue top government officials for racial profiling and other abuses.
The split decision from a three-judge panel on the Second Circuit Court of Appeals comes after more than a decade of litigation, and could lead to increased scrutiny on the government’s behavior following the 2001 terror attack.

This is more of the “can we go back” mindset that’s gripping the country, gripping our politics. Sorry, we can’t go back. Nearly 3,000 people died on Sept 11. Those who say we have to get used to it really don’t know what they’re talking about. If you remember, many were talking what was going to be our “proportional response”. The threat level was high then. Today, the threat level is equally high, or likely much higher. Hypotheticals don’t mean much, but it seems that’s all we can talk about.
