The Trump DOJ is asking Judge James Boasberg for an emergency stay in a case involving the removal of Venezuelan gang members. The entire motion is worth reading, but the bottom line is simple: there’s no valid reason for the judge to deny the request.
Margot Cleveland points out that the judge doesn’t actually need this information. He already has enough to decide whether the Trump administration should be held in contempt for allegedly not turning planes around after they left U.S. airspace. If he believes the administration violated his order, he has what he needs.
So why is he insisting on detailed information about the flights, including aircraft movements and foreign interactions? Julie Kelly highlights the DOJ’s argument that Boasberg is overstepping his authority. The judge is inserting himself into executive branch decisions involving national security and foreign affairs—matters that are not within his jurisdiction. The DOJ even warns it might invoke the state secrets privilege if necessary.
Up to this point, Cleveland has argued that Boasberg’s decisions were horribly wrong but not necessarily malicious. But if he denies the DOJ’s request for a stay, it will prove that he is intentionally creating a constitutional crisis. There is no urgency for him to obtain this information, nor is it even necessary to make a ruling on contempt. The only reason to keep pushing is to assert judicial superiority over the executive branch.
Kelly cites the DOJ’s fiery response:
“What began as a dispute between litigants over the President’s authority to protect the national security and manage the foreign relations of the United States… has devolved into a picayune dispute over the micromanagement of immaterial factfinding.”
In other words, this is no longer about the law. It’s about a judge attempting to wield power he does not have.
On top of that, Cleveland notes that information from the case has already been leaked—something that cannot be ignored, especially in the wake of the Dobbs decision leak. If Boasberg denies the stay, the real motive will be clear: this isn’t about legal oversight. It’s about an activist judge undermining presidential authority.
The judicial and executive branches are coequal, but Boasberg is acting as if the courts have the final say in matters of foreign policy and national security. That kind of overreach needs to end before it turns into a full-blown constitutional crisis.

A good judge that knows his business knows when he/she has jurisdiction and when he/she doesn’t. Either Boasberg is a total moron or he is a radical activist in the business of aiding and abetting the DNC in slowing or stalling everything Trump tries to do (in which case, both could apply). Despite the personal opinion of Justice Roberts, judges shouldn’t get a pass for anything they do, especially when it has national security and the safety of the population implications.
These judges, and this includes those who ignored the Constitution and all evidence to “convict” Trump of bogus charges, need to be removed. No, they NEEEEEEEEEED to be removed. At some point, the rule of law and Constitution has to take over. Just like the left’s reliance on political violence, until it is punished harshly, it will continue and grow worse.
The judge brought up an interesting, if invalid, point.

ALL members are hardened felons from foreign prisons.
ALL of them.
Their goal is to enrich themselves via illegal activities like drug, weapons and human trafficking.
There simply are not any peaceful members of this gang.
As such, this group, this “class” as the judge calls them, are all worthy of deportation.
But this judge is also a hardened leftist activist judge who is flailing around to try to slow down Trump’s Administration.
It’s lawfare, plain and simple.
