Three days ago, Jack Smith filed a superseding indictment against Donald Trump. That’s highly significant for a reason. It demolishes the veneer of impartiality and destroys something else.
Three years ago, I wrote an article about how US Attorney David Weiss tipped the election in favor of Joe Biden by burying the Hunter Biden tax and laptop scandals.
Weiss was praised for his restraint in not indicting the younger Biden.
Last summer, federal officials in Delaware investigating Hunter Biden faced a dilemma. The probe had reached a point where prosecutors could have sought search warrants and issued a flurry of grand jury subpoenas. Some officials involved in the case wanted to do just that. Others urged caution. They advised Delaware’s U.S. Attorney, David Weiss, to avoid taking any actions that could alert the public to the existence of the case in the middle of a presidential election.
“To his credit, he listened,” said a person involved in the discussions, reported here for the first time. Weiss decided to wait, averting the possibility that the investigation would become a months-long campaign issue.
By last summer, the probe had reached a point at which investigators could have issued grand jury subpoenas and sought search warrants that might have revealed its existence at a time when many of then-President Donald Trump’s supporters were seeking to draw attention to Hunter Biden’s actions.
Weiss, however, decided to delay taking any actions that were likely to make the existence of the Hunter Biden probe public. Concerns about affecting the presidential election loomed large when Weiss entertained arguments about advancing the probe, according to the person involved in the discussions. No matter what he did, the decision was sure to come under scrutiny for signs of politicization.
Obviously, Weiss was protecting his local friend Joe Biden. The argument was that Weiss’s inaction was in accord with a long-standing DOJ policy:
The department has an unwritten practice, known as the 60-day rule, under which it traditionally avoids taking investigative steps close to an election that could influence how people vote. The idea is to avoid any appearance of abusing law enforcement power to affect democracy.
Naturally, since then the left has been calling for the abandonment of said policy. Andy McCarthy noted that there is really no such “rule”, but it is manipulated to suit the needs of a party.
It was invoked to save Joe and Hunter Biden, but it is ignored in the pursuit of Donald Trump.
No one should ever again suggest that either Garland or Smith are even-handed or non-partisan. Merrick Garland is a hack and keeping him from the Supreme Court in retrospect was democracy-saving action. Smith is just evil.
Then again, this opens the door for Donald Trump’s DOJ to hand out indictments as it sees fit over the next four years, even if the charges are trumped up as they currently are now. The precedent is set.
It’s lawfare all around.
