Under the public radar, and little talked about in the MSM is the growing expansion of government intrusion into our privacy and the expansion of it’s control over internet. Let’s look at some of this:

U.S. Weighs Wide Overhaul of Wiretap Laws

WASHINGTON — The Obama administration, resolving years of internal debate, is on the verge of backing a Federal Bureau of Investigation plan for a sweeping overhaul of surveillance laws that would make it easier to wiretap people who communicate using the Internet rather than by traditional phone services, according to officials familiar with the deliberations.

The F.B.I. director, Robert S. Mueller III, has argued that the bureau’s ability to carry out court-approved eavesdropping on suspects is “going dark” as communications technology evolves, and since 2010 has pushed for a legal mandate requiring companies like Facebook and Google to build into their instant-messaging and other such systems a capacity to comply with wiretap orders. That proposal, however, bogged down amid concerns by other agencies, like the Commerce Department, about quashing Silicon Valley innovation.

A central element of the F.B.I.’s proposal is to expand the Communications Assistance for Law Enforcement Act — a 1994 law that already requires phone and network carriers to build interception capabilities into their systems — so that it would also cover Internet-based services that allow people to communicate. Fines could start at $25,000 a day.

Albert Gidari Jr., who represents technology companies on law enforcement matters, criticized that proposed procedure. He argued that if the United States started imposing fines on foreign Internet firms, it would encourage other countries, some of which may be looking for political dissidents, to penalize American companies if they refused to turn over users’ information.

“We’ll look a lot more like China than America after this,” Mr. Gidari said.

The 1994 law would be expanded to cover peer-to-peer voice-over-Internet protocol, or VoIP — calls between computers that do not connect to the regular phone network. Such services typically do not route data packets through any central hub, making them difficult to intercept.

The Federal Bureaucracy has been continually spreading it’s roots of control into various areas of the new medium. This has been very worrying to advocates of internet privacy and freedom.

The FBI’s proposal requires Internet communication companies to build in a wiretapping capacity, and will establish fines for companies that do not cooperate.

“I think the F.B.I.’s proposal would render Internet communications less secure and more vulnerable to hackers and identity thieves,” said Gregory T. Nojeim of the Center for Democracy and Technology. “It would also mean that innovators who want to avoid new and expensive mandates will take their innovations abroad and develop them there, where there aren’t the same mandates.”

Andrew Weissmann, the general counsel of the F.B.I., said in a statement that the proposal was aimed only at preserving law enforcement officials’ longstanding ability to investigate suspected criminals, spies and terrorists subject to a court’s permission.
“This doesn’t create any new legal surveillance authority,” he said. “This always requires a court order. None of the ‘going dark’ solutions would do anything except update the law given means of modern communications.”

…Months before the debate about Internet censorship raged as SOPA and PIPA dominated the concerns of web users, President Obama signed an international treaty that would allow companies in China or any other country in the world to demand ISPs remove web content in the US with no legal oversight whatsoever.

Obama has signed the following executive orders:

Assignment of National Security and Emergency Preparedness Communications Functions
Cyber Intelligence Sharing and Protection Act, or CISPA.
The “top secret “Presidential Policy Directive 20 on cyber-security. (This may be innocuous, but as it’s classified and a non-secret summery has not been released, who can say?)

And the following controversial laws and treatys:

21st Century Communications and Video Accessibility Act (CVAA)
Stop Online Piracy Act (SOPA)
Preventing Real Online Threats to Economic Creativity and Theft of Intellectual Property Act (PIPA)
Anti-Counterfeiting Trade Agreement (ACTA)

Currently proposed are:

Leadership of both parties seems to have little problem with the expansion of government control of the internet and expanding it’s ability to spy on the public. How far should we trust the government? It is truly appalling in today’s “information age” what we don’t know because the MSM and our government wont inform the public.

Neither Obama nor Congress has officially declared war on the American people, nor have they suspended our Constitution (which would be a treasonous act in itself). That you think that a President and his administration “can do pretty much whatever he wants”, so long as he declares it is related to a war effort, simply shows how ignorant you are. War powers are not limitless, and even your fellow Democrats understood this truth during Bush’s reign.

Recently, in a series of decisions — Hamdi vs. Rumsfeld (2004), Rasul vs. Bush (2004) and Hamdan vs. Rumsfeld (2006) — the Supreme Court has again rejected the notion that the executive may do pretty much as it pleases in wartime, regardless of congressional input. As a result, the Bush administration was dragged kicking and screaming into seeking authorization from Congress — for the Detainee Treatment Act (2005), Military Commissions Act (2006), the Protect America Act (2007) and now two pending bills to reautho rize the Terrorist Surveillance Program (the RESTORE Act in the House and the FISA Amendments Act in the Senate).

The rules don’t change simply because it is your guy who occupies the office.

Let’s keep in mind that Bush wanted to track known or suspected terrorists in the USA that were not US citizens. The law didn’t apply to US citizens. obama wants to be able to tap into all that we do.

It is not so far-fetched to imagine a government spying on people’s website visits and using the IRS or other government agencies to intimidate them, particularly not after the IRS admitted to more scrutiny to organizations applying for tax-exempt status simply because of a few code-words in their application.

Just remember how any of the various murdering thugs went about purging their countries of the “dissidents” they identified. History can teach us a lot. One of the things that it teaches us is that some people will go to any lengths to quiet voices of contention to their idealistic visions of how the world should be.

The real capabilities and behavior of the US surveillance state are almost entirely unknown to the American public because, like most things of significance done by the US government, it operates behind an impenetrable wall of secrecy. But a seemingly spontaneous admission this week by a former FBI counterterrorism agent provides a rather startling acknowledgment of just how vast and invasive these surveillance activities are.

This came out during the Boston Bombing investigation:

BURNETT: Tim, is there any way, obviously, there is a voice mail they can try to get the phone companies to give that up at this point. It’s not a voice mail. It’s just a conversation. There’s no way they actually can find out what happened, right, unless she tells them?

CLEMENTE: “No, there is a way. We certainly have ways in national security investigations to find out exactly what was said in that conversation. It’s not necessarily something that the FBI is going to want to present in court, but it may help lead the investigation and/or lead to questioning of her. We certainly can find that out.

BURNETT: “So they can actually get that? People are saying, look, that is incredible.

CLEMENTE: “No, welcome to America. All of that stuff is being captured as we speak whether we know it or like it or not.”

“All of that stuff” – meaning every telephone conversation Americans have with one another on US soil, with or without a search warrant – “is being captured as we speak”.

The implications are clear:

Let’s repeat that last part: “no digital communication is secure”, by which he means not that any communication is susceptible to government interception as it happens (although that is true), but far beyond that: all digital communications – meaning telephone calls, emails, online chats and the like – are automatically recorded and stored and accessible to the government after the fact. To describe that is to define what a ubiquitous, limitless Surveillance State is.

Update: Govt obtains wide AP phone records in probe

WASHINGTON (AP) — The Justice Department secretly obtained two months of telephone records of reporters and editors for The Associated Press in what the news cooperative’s top executive called a “massive and unprecedented intrusion” into how news organizations gather the news.

The records obtained by the Justice Department listed incoming and outgoing calls, and the duration of each call, for the work and personal phone numbers of individual reporters, general AP office numbers in New York, Washington and Hartford, Conn., and the main number for AP reporters in the House of Representatives press gallery, according to attorneys for the AP.

Looks like now that the MSM has finally started reporting on the Begazi cover-up, Holder and Obama are firing a warning shot over their bows. Going after the AP is a very dangerous move for this administration.

In a letter of protest sent to Attorney General Eric Holder on Monday, AP President and Chief Executive Officer Gary Pruitt said the government sought and obtained information far beyond anything that could be justified by any specific investigation. He demanded the return of the phone records and destruction of all copies.

“There can be no possible justification for such an overbroad collection of the telephone communications of The Associated Press and its reporters. These records potentially reveal communications with confidential sources across all of the newsgathering activities undertaken by the AP during a two-month period, provide a road map to AP’s newsgathering operations, and disclose information about AP’s activities and operations that the government has no conceivable right to know,” Pruitt said.

There appears to be no specific reason given behind the Justice Department’s demands, nor any indication of what they are looking for. The 1st Amendment implications should have every new organization sitting up and taking notice. I for one will look forward to watching the blow-back on this.

Somewhat related: OBAMA’S SIGNATURE MOVE: UNSEALING PRIVATE RECORDS

Bear with me here. I’m going to jump around a bit in this article before making my end point as to why this is relevant.

Obama’s usual campaign method, used in 100 percent of his races, has been to pry into the private records of his opponents.

Let’s take a romp down memory lane and review the typical Obama campaign strategy. Obama became a U.S. senator only by virtue of David Axelrod’s former employer, the Chicago Tribune, ripping open the sealed divorce records of Obama’s two principal opponents.

Those records were under seal, but as The New York Times noted: “The Tribune reporter who wrote the original piece later acknowledged in print that the Obama camp had ‘worked aggressively behind the scenes’ to push the story.” Many people said Axelrod had “an even more significant role — that he leaked the initial story.”

After having held a substantial lead just a month before the primary, Hull’s campaign collapsed with the chatter about his divorce. Obama sailed to the front of the pack and won the primary. Hull finished third with 10 percent of the vote.

As luck would have it, Obama’s opponent in the general election had also been divorced! Jack Ryan was tall, handsome, Catholic — and shared a name with one of Harrison Ford’s most popular onscreen characters! He went to Dartmouth, Harvard Law and Harvard Business School, made hundreds of millions of dollars as a partner at Goldman Sachs, and then, in his early 40s, left investment banking to teach at an inner city school on the South Side of Chicago.

Ryan would have walloped Obama in the Senate race. But at the request of — again — the Chicago Tribune, California Judge Robert Schnider unsealed the custody papers in Ryan’s divorce five years earlier from Hollywood starlet Jeri Lynn Ryan, the bombshell Borg on “Star Trek: Voyager.”

Jack Ryan had released his tax records. He had released his divorce records. But both he and his ex-wife sought to keep the custody records under seal to protect their son.

And that’s how Obama became a U.S. senator. He destroyed both his Democratic primary opponent and his Republican general election opponent with salacious allegations about their personal lives taken from “sealed” court records.

Obama’s team delved into Sarah Palin’s marriage and spread rumors of John McCain’s alleged affair in 2008 and they smeared Herman Cain in 2011 with hazy sexual harassment allegations all emanating from David Axelrod’s pals in Chicago.

It’s almost like a serial killer’s signature. Unsealed personal records have been released to the press. Obama must be running for office!

Pretty hypocritical for a politician who insured that all his own records are sealed. This is precisely why we must oppose these expansions of “big Brother” intrusions. Given all this and connecting all the dots, with the current IRS scandal, and the Justice Department now going after the AP held in mind, we can clearly see the danger in having a high power ideological extremist administration, (with a record of improperly using sealed records against what they may consider as political opponents,) in control of the highest office of our nation. All Americans (including the MSM) should be chilled by these revelations.

The IRS admits to ‘targeting’ conservative groups, but were they also ‘leaking’?

In a 2012 speech, Sen. Mitch McConnell noted, “The head of one national advocacy group has released documents which show that his group’s confidential IRS information found its way into the hands of a staunch critic on the Left who also happens to be a co-chairman of President Obama’s re-election committee. The only way this information could have been made public is if someone leaked it from inside the IRS.”

And so, the next question may be this: If the IRS was targeting conservative groups — as they now admit to doing — were they also leaking information?

UPDATE: In December of 2012, ProPublica wrote that they had obtained the application for recognition of tax-exempt status for Crossroads GPS, filed in September of 2010

Remember that as stated above, in previous elections Obama operatives released not-public records to aid their campaign.

Now — on the heels of news the IRS’s apology for having targeted conservative groups — NOM is renewing their demand that the Internal Revenue Service reveal the identity of the people responsible.

“There is little question that one or more employees at the IRS stole our confidential tax return and leaked it to our political enemies, in violation of federal law,” said NOM’s president Brian Brow, in a prepared statement. “The only questions are who did it, and whether there was any knowledge or coordination between people in the White House, the Obama reelection campaign and the Human Rights Campaign. We and the American people deserve answers.”

Paraphrasing a saying the religious community has: If you were accused of being a Tea Partier, would there be enough evidence to convict you?

I’ve been to most of the Tea Party rallies in washington d.c., and mailed obama his Pink Slip, and I signed it, so I’m guessing they have a pretty big file on me. I’m guessing that Curt’s would win first place easily, so he should be disqualified from entering the contest.

Since you are sponsoring the contest, you have to come up with prizes for the winners. Maybe there could be categories.

I am rich in many way, but not financially. If I could go back in time knowing what I know now, I probably would have been able to retire around age 50, like a lot of people I have talked to have.

You reminded me of a CB conversation. Sometimes when truck drivers were talking about how wealthy some people are, I would say, “All I want is to be paid what I’m worth for one year, then I could quit, retire, and live quite well the rest of my life. I would then wait for the negative answers, which would be a very small amount.

One time when I said the above, one driver said, “I’d like to buy that guy at what he IS worth, and sell him for what he THINKS he’s worth.” For some time after that I was a little mad at him for the answer. He hurt my pride. Then, I finally figured if you ask for something, and you get what you asked for, you can’t complain, and I have been laughing ever since. I wish I would have thought to ask him how much of a profit he thought he would make.

This reminds me of other CB conversations where drivers would be talking about how fast their trucks would go. I would say, “All I want is to drive a truck that would my IQ, just so I would know what it feels like.” I would usually get the, “You need to drive for Schneider.” answer, because at that time they paid their drivers to drive 55. One time, a driver told me, “You’d be driving backwards.” I didn’t like that answer either.

Recently, I installed Norton Internet Security, which includes a program to stop tracking. On the page we are on now, it says it is blocking Google + 1, Facebook Connect, and six companies from tracking me, two of them Google companies, and it has a total of 84,826 blocks since I installed it about a month ago.

I have it set up so that any application that tries to use the Internet will open up a window that asks me if I want to allow it. I decide what goes in or out of my computer. It is well worth the price of the software just for the blocking feature.

Anyone who uses Google is just supporting a very liberal company that helped obama get elected by being able to tell them which people to call or mail to, and which ones not to waste their time one (like frequent readers of Flopping Aces).

There are search engines that don’t track your web searches. Just put something like, “search engines that don’t track you” in your search window and pick one. I picked Ixquick at random, and I find things I want with it. Google also edits their help suggestions for your searches so that you don’t go where they don’t want you to. If you ever see a window that tells you that going to that web sight could harm your computer, that is the one you should go to. It seems to always be CONSERVATIVE blogs where that window pops up.

I went to a Mac years ago. I got tired of my PC crashing as much as it did. Macs never used to have viruses, because nobody made any for them since the PCs had a much bigger percentage than they do now. The viruses are coming to the Macs now, so I got the protection software.

I hope nobody went to Windows 8 yet. I haven’t read anything good about it yet, only bad. It seems Windows puts out their stuff and lets the customer test it. I have said that Vista sold more Macs than anything when it had the problems it did. Apple used Vista’s problems to sell more Macs:

Originally, the democrats wanted the illegals for votes. The republicans wanted them because the businesses who donate to the GOP wanted the cheep labor. The republicans now see that they to can get votes from the illegals. The politicians think it is better to save their careers than to save the country.
