Pelosi – Obama Should Bypass Congress & Raise The Debt Limit Himself

This lady is a clown….a perfect poster child for the Democrat party:

“I’m a big fan of the Constitution. The credit validity of the United States shall not be in question. You cannot put the country through the uncertainty. We lifted the debt ceiling, right? We still got the credit rating taken down because of the uncertainty of it all. You cannot flirt with this. This is really dangerous. I would like to see the Constitution used to protect the country’s full faith and credit, as the Constitution does.”

So once more the Democrats want to bypass the Constitution and rule the American people as subjects as a monarchy would. She, and many other Democrats, claim the 14th Amendment authorize Obama to bypass Congress and just unilaterally raise the debt limit. Completely false. The 14th Amendment:

“The validity of the public debt of the United States, authorized by law, including debts incurred for payments of pensions and bounties for services in suppressing insurrection or rebellion, shall not be questioned.”

The public debt referenced in that Amendment is the debt ALREADY issued. They aren’t this stupid. They just don’t care.

Only Congress can raise the debt ceiling.

Former federal Judge Michael McConnell:

Legislative control over incurring new debt is a fundamental aspect of separation of powers, going back to Parliament’s curtailment of the royal prerogative of borrowing in the wake of the Glorious Revolution of 1688. Article I, Section 8, Clause 2 empowers Congress, and only Congress, “to borrow money on the credit of the United States.” Without congressional authorization, the President may no more borrow money than he could make new criminal laws, declare war, or enact a new spending program. The “debt ceiling” is simply the limit Congress has imposed on how much money the country may borrow. The executive branch cannot constitutionally borrow a dime in excess of this amount.

Section Four of the Fourteenth Amendment does not create a back-door method for the Administration to borrow more money without congressional authorization. For Congress to limit the amount of the debt does not “question” the “validity” of the debt that has been “authorized by law.” At most, it means that paying the public debts and pension obligations of the United States, as they become due, has priority over all other spending.

Unfortunately I wouldn’t be surprised if he took her advise. What else can you expect from this administration?

• After an Internet regulation proposal failed to make it through Congress, the Federal Communications Commission announced that it would regulate the Web anyway, even despite a federal court’s ruling that it had no authority to do so.
• Although Congress consistently has barred the Department of Education from getting involved in curriculum matters, the Administration has offered waivers for the No Child Left Behind law in exchange for states adopting national education standards, all without congressional authorization.

Likewise, the Administration has often simply refused to enforce laws duly enacted by Congress:

• Since it objects to existing federal immigration laws, the Administration has decided to apply those laws selectively and actively prevent the state (like Arizona) from enforcing those laws themselves.
• Rather than push Congress to repeal federal laws against marijuana use, the Department of Justice (DOJ) simply decided it would no longer enforce those laws.
• DOJ also has announced that it would stop enforcing the Defense of Marriage Act or defending it from legal challenge rather than seeking legislative recourse.

On Tuesday, the President invoked executive privilege to avoid handing over some 1,300 documents in an ongoing Congressional investigation. The Supreme Court has held that executive privilege cannot be invoked to shield wrongdoing.

Whats the Constitution to this man other than a piece a paper to burn.
