    I just happened to be reading my constitution today, and this jumped out at me:

    “Section 4 – Disqualification
    The President, Vice President and all civil Officers of the United States, shall be removed
    from Office on Impeachment for, and Conviction of, Treason, Bribery, or other high
    Crimes and Misdemeanors.”

    There is some grumbling on the blogs about treason, but treason involves making war against the country which might be very hard to prove. The next reason to remove an officer of the government, BRIBERY, would be much easier; it is all in the congressional record.

    Hopefully (that word again), smart legal minds are looking into this. But conservatives will need a majority in the house to commence proceedings.

    It may be a long, hot summer before the refreshing winds of November come.

  11. It is amazing that the media has completely taken a pass on the lies told during the past few days about this bill “reducing” the deficit. The Taxes are going to sky-rocket, and the anti-business wave will be a disastrous for all those looking for work.

    . . . And why is there still no talk of tort reform? This alone would reduce the health care costs by $200,000,000 +.

    This is destructive.

    I would appreciate the opinion of you good folks (especially the proprietors of this site) on something I think might happen as a result of this Health Care Bill that nobody seems to be talking about. I may be wrong, but I took courses at West Point in Constitutional Law and I’ve seen 35-years of politics, and something keeps nagging me about this fiasco. Let me explain: I believe A BILL will eventually become law but several provisions of THIS SENATE BILL, and the final Bill containing the reconciliations will be handed a temporary injunction and will be ultimately thrown out as Unconstitutional by the SCOTUS. Among those SHOULD BE the “Individual Mandate” and the “Special State Deals” granted like “The Cornhusker Kickback” and several others. On the former, the SCOTUS must decide if it’s a “fine” or a “tax” levied against those that refuse to participate. I think it’s a fine, because a tax is levied on ALL Americans with some exemptions, and a fine is levied on those who break a law, and if it’s a fine, then it’s Unconstitutional because Congress has jurisdiction over taxes. The Justice Dept has jurisdiction over fines….so on to the latter: It is EXPRESSLY STATED in the Constitution that all Federal laws or mandates must be universally applied to all members of the union. I think these special backroom deals clearly violate the Constitution, and I think that IF…IF the SCOTUS sees it that way it could lead to criminal charges, ethics admonishment and forced resignations of several lawmakers. I wouldn’t go so far as to say it would lead to impeachment of the Chief Executive (because he skillfully avoided personal participation in those deals)but one never knows. There could be a smoking gun out there in the way of e-mails or taped conversations of Obama “signing off” or even advocating such illegal payoffs. That would make Watergate look like childs play. Does anyone else see this as realistic? Thanks in advance for your responses.

And another thing I forgot to mention also: If the President signed a law that he was previously advised by counsel was unconstitutional, the President faces immediate removal for violating his Oath of Office “To Defend the Constitution.” I find it hard to believe Obama wasn’t advised of this, yet he rammed the Bill through anyway. MataHarley: Try running that past Glenn Reynolds if you have “an in” to him. He’s a professor of constitutional law at Tennessee Uni. I would just relish the spectacle. (And the bloodbath at the polls).

  22. @Nostradamus: The Supreme Court is very reluctant to involve itself in what it sees as political matters under the prerogative of the legislative branch.

    Interestingly enough, the Federal Courts didn’t seem to have that problem when they overrode law and reinstated ACORN funding.

    But sadly, I don’t expect much of these court challenges.

    The real battle is political and that’s where I intend to focus my energy.

    Still, there are multiple legitimate issues that the court should address as you describe above and I wish they would.

    But wishes don’t get you too far in a courtroom.

    Much as I’d like to see Pelosi gone, there are avenues that I would not support… as in dictation of working age limits. But perhaps if you clarify what you thought I should run by Glenn Reynolds, I could get a better handle on what you were suggesting.

    The Resolution/House Rule change… also called the deem and pass rule… was not utilized. Therefore there is no signing of a law that is unconstitutional involved to challenge on procedure. Also, any challenge for that would entail whether Pelosi and Reid sanctioned that passage… also called the Enrollment Bill Rule. It’s a dead avenue.

    The only court challenge with merit remains with the states, and on the 10th Amendment. There is no dearth of these at the moment. Florida for sure and up to nine states in possible progress for the same. Also, there is the state legislation going thru, or pending, that is busy gutting the legislation. When the federal law is in conflict with state law, that is another 10th Amendment challenge that appears before the courts.

    @Mike’s America: The real battle is political and that’s where I intend to focus my energy.

    That is certainly a commendable focus, Mike. However in terms of the law to be enacted as of tomorrow morning – HR 3590 as passed and amended by the Senate – doesn’t make a dent in the damage done. If you want to reverse this the GOP will need to assume some veto proof power in the Congress, as well as the WH. Other than that, we have just taken a new turn into Euro-socialism, on the quest to single payer in Obama’s new America.

    Court challenges are the only stay to the execution. You concentrate on political make up of the branches of power to prevent further damage. I’ll keep focused on reversing the damage.

  24. @MataHarley: I’d love to be wrong for a change but my experience tells me that the legal challenge is limited in it’s ability to kill this monster.

    Our best hope remains the even harder task of assembling the conservative majority in both houses and taking the White House.

    It’s a long term strategy that might disappoint some who are looking for an instant fix.

    But it’s my opinion that there is no workable instant, or even short term fix.

    Again, I’d like to be proved wrong, but it doesn’t happen very often.

    I was hoping Nobama would sign the bill today as on March 22, 1765 The Stamp Act was passed by the British Parliament — would make it a “two-fer” of disastrous political decisions.

    Everyday has it’s positives and negatives but Birthdays are special and outweigh any negative events — Maybe you entered the world on this day to help balance out tyrannical efforts.

    We could try the Dorothy method and dump a bucket of water on belle-a-Pelosi to see if she melts away.

    Even if the bill get’s past the SCOTUS this time, there would be another chance for reversal of the Individual Mandate on Constitutional grounds through the federal courts system, once the IRS dares to enforces this law on a US Citizens.

    The press is claiming that the Democrats will probably “lay-low” until after the November elections. I don’t believe this for a second, as I have a sneaking feeling that: Since they expect heavy losses in November, they have little to lose and will try to push though as much far-left agenda items while they still have a Democratic majority. I expect that Obama next will try to get his socialist-youth children indoctrination corps program or a far-left version of immigration reform passed while he still has Democratic control. I also suspect that they will use this to try to get voter support from Hispanics.

    The completely disingenuous, heavy handed, sleazy and corrupt way that Democrat leadership has behaved has turned my stomach. and made me both angry and in fear of what else they might do. The “Blue-Dog” Democrats should have spoken out loudly against the exclusion of Republicans from the process, and reigned in the draconian behavior of the far-left. As such I will be hard pressed to ever again vote for any Democrat. This doesn’t necessarily mean I’ll vote Republican, as I think that many of them are just as bad but in different ways. If worse comes to worse, I’ll go third party.

    Republicans, if you want my vote, you’d best not be a corporate “free-trade” slavering lackey, A big-banker buddy, an elite-family prince-ling, or a card carrying 700-club member. We need liberty-minded conservatives. Roll-up-your sleeve Statesmen who represent the middle-class, the like of George Washington, John and Samuel Adams, Ben Franklin, Nathan Hale, Chuck Norris, Sara Palin, Ted Nugent, Tom Sellack, Ron Paul. I totally agree with the opinion that if not this Bill in it’s entirety, A Bill is here to stay, unless Republicans can muster up a 2/3 majority in both Houses and a Republican President that would not over-ride with a veto for a motion to repeal. Unfortunately, the demographic makeup of America makes such a super-majority almost impossible (Barring a massive direct attack on America, I would think). It’s no secret that without the inner-city vote, few Democrats would win a National election.     Just a thought though: Isn’t it possible to kill a Bill if Republicans just win a majority in the Legislative Branch……and cut off funding for major parts of this Bill? I’m not so sure that most people would oppose that, in light of our disastrous budget deficits and National Debt. In fact, I believe that in many districts in play Republicans could win big just by running on that mantra. Thoughts?

With one party having control of the executive branch and the legislative branch and the judicial branch operating in slow motion in fear of the other branches that appointed them, we live in a unregulated single party government. Pelosi can do what she wants until she is removed. The liberals have more targets – immigrattion reform to bring them millions of new voters, gun control, and finally control of the energy industry in the US giving the government control over banking, health care, energy, education loans, and the automotive industry.     I’m not a Biblical scholar, but as a Christian, I’ve heard many sermons/teachings on the end times. The most common conclusion people come to is quoting Jesus’s words: “But of that day and hour, no one knows, no, not even the angels of heaven, but My Father only” (Matt.24:36). Of course, that’s usually interpreted as we just don’t know, so why speculate or try to predict it.

    For me personally, I have come to the conclusion that I should just live my life as I always have, which is to basically to love God first and foremost , and to lovingly treat others as I’d want to be treated. I don’t think God wants us to live in fear of could be around the corner, as that takes away from living joyfully in the present.

    I respect your opinion and appreciate very much your conviction, but I just know that when I’ve heard teachings about the end times in the past, I usually come away more scared than strengthened. But, you must do what you feel you should, of course.

My freedom comes from my creator and they will never take that away from me. I support Israel!!!!
