The last-minute arm-twisting and deal-making being done today may indicate Pelosi still doesn’t have the votes to pass. She may be in the 210-215 range. If she has 216+, the HCR bill (or rule change) would have been moved to a quick vote. Or, the last-minute stuff could be vote maintenance.

With regard to the Boehner request for on-the-record vote of Senate amended HR 3590, I don’t see that happening either. Pelosi would rule that out of order. A voice vote would be pretty good, voting for a ‘misdirection’ rule change (deeming) better.

With regard to judicial review, that’s a mixed bag. It’ll be a case of whether Mark Levin, or matter of fact any other party, has legal standing for a challenge, i.e., Levin needs to show how he is harmed. We know the first four years (2010-14) is primarily the collection of taxes before the actual beginning of “benefits” in late 2014/early 2015. If Levin can show he’ll be bankrupted by the extra taxes this year or next, then he may have standing. I would say us regular folk would have a better chance of making the claim we would be bankrupted by the extra taxes.

Obama thinks this is to be his legacy. In a sense, he’s right. The bankrupting of America will be his legacy but that’s not all. The trashing of the legislative process will also be Obama’s legacy. His abuse of the office will be his legacy.

In all of history Democrats have never, ever been able to contain the costs of anything and they will fail to do so here. When the complaints start accumulating they will use the promise of increased benefits as bait for election and re-election votes. This will explode the costs of health care but they will care as little then as they do now.

INRE the Boehner request to Pelosi. No chance she’d do it. That would be, in essence, voting for the Senate version of HR3590 on the record. The entire point of the specialty rule is to avoid that moment.

Good publicity, but will fall on deaf ears. And the fact that it does is a litigation plus.

I understand what you’re saying vis a vis the Courts and law enactment.

I was simply pointing out that the Constitution has a clear provision for the yeas and nays of the members to be recorded in the journal of the respective house if 1/5 of those present request it.

That provision of Article I is plainly clear even if the CryptKeeper decides to decline Boehner’s request.

@Aye Chihuahua: Despite your penchant for Article I Sect. 5, the Constitution does not prescribe the specifics of law enactment, and still leaves the proceeding rules to the chambers themselves.

As I have pointed out above, there are instances where the Supremes have left the validity of the proceedings to the surface evidence, and other times where they verified sources by checking the journals.

However the mandate that they keep a journal of as a prerequiste to legally enacted statute is only so when the Supremes deem it so.

All in all, until we know just what procedure they use to attempt to enact O’healthcare, the avenue thru the courts is not clear.

The only thing that is clear is that O’healthcare is apt to be challenged on multiple fronts… and many of them have an excellent chance in succeeding.

Article I, Section 5 of that pesky US Constitution could always be invoked. All they need to demand a roll call vote is 1/5 of those present agreeing to such:

Each House shall keep a journal of its proceedings, and from time to time publish the same, excepting such parts as may in their judgment require secrecy; and the yeas and nays of the members of either House on any question shall, at the desire of one fifth of those present, be entered on the journal.

It is a sobering and chilling experience to see history’s greatest achievement, the concept of ‘individual Freedom and representative government’, so wantonly and willfully destroyed by Obama’s Marxist sycophants.
