Yes, Congress “granted Bush that power” (although it was not so much a granting of power as it was a suspension of a prohabition. Only Congress could “grant” it, and it was passed as an emergency act, specifically at President Bush’s request, following Hurricane Katrina. After the Katrina emergency (thankfully,) Congress reinstated the Posse Comitatus Act. However, when Bush signed the bill (reinstating the act) he hand wrote that he would not be bound by Congress’ reinstatement of the Posse Comitatus Act.

(This writing in alterations of bills was something that George Bush on various occasions, was know to do. I seriously doubt that a President’s altering of a bill would ever pass SCOTUS approval, else a President could “Line Item Veto” anything in a bill he doesn’t agree with, in direct violation of the Constitution’s “Separation of Powers” clause.)

The Governor, National Guard and all state and local law enforcement were overwhelmed by Katrina. Posse Comitatus allows for the Military to mobilize for relief efforts and rescue activities. It however forbids the military to be used against the people (for valid historical reasons). I do not entirely trust the Department of Homeland Security (assuming that the DHS is what you meant by “HLS”). They are very demanding of being given more and more power and are placing tendrils into far too many aspects of our lives. Not even the FBI, CIA or NSA has been allowed so much.

What deeply concerns me about all this, is that having done it once, Congress could easily do it again for some other “National emergency.”

You know, I was not aware that bill was even written. I had never heard of it which is amazing when you consider I am an avid reader of blogs and Fox. However, Catherine says congress never granted Bush those powers. That is understandable since congress represents the people of their states, at least, they did in those daysbut evidently not today.

If I had known about it I would have been against giving the president this power also. Posse Comitas is there for a a reason and that reason is to bar the federal government from taking over a state on any pretext. The governor of Louisiana and the mayor of New Orleans to quote Obma “acted stupidly” but it is not the role of the federal govoernment to fix that without invitation.

It is not the role of the federal government to take over a state’s disaster even though the government of that state is incompetent. It is up to the electorate of that state to elect intelligent people who will govern with some common sense. If they can’t do that they deserve what happens to them. The electorate definitely should not elect officials who will not seek help in a disaster for political reasons. In other words I do not believe in infringing on the states rights under any circumstances. States rights may be the only thing that will save us.

If you take Catherine’s advice and stockpile flour, freeze it if you can. It doesn’t exactly go bad, but the flavor changes over time, and not for the better. Same with rice. Also, you may not have bugs in your house, but you may import some in product you bring home from the store – freezing will kill off any bugs or “beginner” bugs.

Also, if you’re going to stockpile flour, you might want to buy some kind of automatic bread machine. After all, if the price of flour becomes prohibitive, so will the price of bread. You can already save about 2/3 of the cost of bread by making it yourself – I’d assume that the savings would be equal or better in a situation of shortage.

Besides…you can set your bread machine to make the bread during the night so that it finishes up right in time for breakfast. You get up to the smell of freshly baked bread…mmmmm. Yummy. That’s enough of a reason without the shortage. Still – you need to practice, you know – just in case!

Most people are not aware of a related issue: George Bush started this with his 2007 temporary repeal of Posse Comitatus:

On September 26, 2006, President Bush urged Congress to consider revising federal laws so that U.S. armed forces could restore public order and enforce laws in the aftermath of a natural disaster, in the wake of Hurricane Katrina. These changes were included in the John Warner National Defense Authorization Act for Fiscal Year 2007 (H.R. 5122), which was signed into law on Oct 17, 2006, subsequently repealed in their entirety.[2] Section 1076 is titled “Use of the Armed Forces in major public emergencies”. It provided that:

“The President may employ the armed forces… to… restore public order and enforce the laws of the United States when, as a result of a natural disaster, epidemic, or other serious public health emergency, terrorist attack or incident, or other condition… the President determines that… domestic violence has occurred to such an extent that the constituted authorities of the State or possession are incapable of maintaining public order… or [to] suppress, in a State, any insurrection, domestic violence, unlawful combination, or conspiracy if such… a condition… so hinders the execution of the laws… that any part or class of its people is deprived of a right, privilege, immunity, or protection named in the Constitution and secured by law… or opposes or obstructs the execution of the laws of the United States or impedes the course of justice under those laws.[3]”

The actual text is on pages 322–323 of the legislation. As of 2008, these changes have been repealed in their entirety, reverting to the previous wording of the Insurrection Act.[4] The changes described in H.R. 5122 above were repealed in their entirety by HR 4986: National Defense Authorization Act for Fiscal Year 2008

I expect that Obama and the Democratically controlled Congress will try to secretly repeal the repeal to make the DoD Proposal you (Barbara) mention possible.

This is another reason why I don’t trust either the Democrats or Republicans.

BarbaraS: You are correct. And the libs would be telling them what rules they are breaking by walking up the escalator to report the problem. After the escalator was working, no thanks would go to the person reporting it and they’d even try to arrest him for “going against the will of the people” and probably call him “un-American”

This proposal by the DoD is the first step in subverting the power of individual states. They want to bring all states under the federal umbrella and completely rule out states rights and governments. They want to do this to destroy any opposition to their plans.

Why could these idiots not just walk up the stairs? I am sure they didn’t just fold up or they would have slid down to the bottom which wouldn’t be a bad thing you understand. They act like they are in an elevator or something. However, as a satire it shows a good picture of the liberal mind. Why isn’t the government there to fix this mucho pronto? Idiots. A conserative would have walked up the stairs and reported the stoppage without a fuss. But then a conservative believes in self reliance.
